Update on court...

Remember this post and this post? Well yesterday was the court date.

I was a nervous wreck....

I had a knot in my stomach…

There were over 100 people in that court room for a traffic citation. The judge came in and gave her speech on how the court was to be addressed that day. Let me tell you I think she really got up on the wrong side of the bed! It came down to something like this:

I will have NO mercy on any of you! If you were sited for speeding and it is reported that the reading was scanned on a Radar you Will pay the fine! We have new radars assigned to Polk County officers and we KNOW for a fact that they work FINE!

She was harsh to say the least. I was told by an officer in another county that is the police officer did not appear in court that they would ask me if I wanted a continuance. This does not appear to be the case in Polk County! As the officer who cited me was no where to be found! I was not offered to get a continuance of the case!

Mrs. Judge called my name and cited my infraction. She asked me how I wanted to plea. I told her with all of my respect, saying Your Honor and Yes Ma’me, No Ma’me. I told her that I was allegedly clocked in the Radar taking a right turn at 54 mph and that with the vehicle that I drive that would be impossible, as this would cause me to top over. I told her that I had requested to see the Radar when I was stopped also and that the officer ignored my request. She looked at me and told me that that was not of her concern that she wanted to know my plea. She also informed me that the officer was in no obligation to show me the Radar. Before I could even answer she said that she needed to warn me that if I pleaded not guilty I would not stand a chance against a Radar infraction and that if I was found guilty I would be fined a minimum of $500 on top of the $161.50 of the ticket for court fees.

I gave up! Pleaded No Contest. She then proceeded to inform me that she would not hold any adjudication against me (no points taken off the license and no need to take any classes).

So I ended up paying the fine.!

It Sucks!

That is not right. So, essentially they are allowing you to come in and fight the ticket, but have absolutely no intention of listening to anything you saw and find everyone guilty. Ridiculous.

This is an injustice! You need to contact an attorney. Bull effing crap.
